What should I do immediately when a death occurs?
Please call us at (937) 268-6869 any time, day or night. We are available 24/7 to transport your loved one into our care. If the death occurs at a facility (hospital or nursing home), notify the staff that Lusain Funeral Home and Crematory Ohio is your chosen funeral home, and they will coordinate the release with us.
Is embalming required by law in Ohio?
No, Ohio law does not strictly require embalming. However, it may be necessary if you select certain arrangements, such as a funeral with an open vessel viewing. If you choose direct cremation or immediate burial, embalming is generally not required.
Who has the legal right to make funeral arrangements?
Under Ohio Revised Code, the right of disposition follows a specific order of priority:
(1)The representative appointed by the decedent to have the right of disposition.
(2)The decedent's surviving spouse.
(3)The decedent's surviving child or children.
(4)The decedent's surviving parent or parents.
(5)The decedent's surviving sibling or siblings.
(6)The decedent's surviving grandparent or grandparents.
(7)The lineal descendants of the decedent's grandparents as spelled out in Section 2105.06 of the Revised Code.
(8)The decedent's personal guardian at the time of death.
(9)Any person willing to assume the right of disposition, including the personal representative of the estate or the licensed funeral director with custody of the body, after attesting in writing and good faith that they could not locate any of the persons in the above priority list.

Cremation FAQs

How long must we wait before cremation can occur?
In Ohio, a minimum of 24 hours must elapse after the time of death before cremation can take place.
What are the legal requirements for cremation in Ohio?
To proceed with cremation, we must:
* File a completed Death Certificate signed by a physician.
* Obtain a Burial-Transit Permit from the local registrar.
* Receive a signed Cremation Authorization form from the legal next-of-kin.
Does your funeral home have its own crematory?
Yes. Lusain Funeral Home and Crematory Ohio operates an on-site crematory. This means your loved one never leaves our care, providing families with greater peace of mind and ensuring the highest standards of dignity and identification.
Can we still have a funeral service if we choose cremation?
Absolutely. Many families choose to have a traditional viewing and funeral service followed by cremation, or a memorial service held after the cremation has taken place.

Burial FAQs

Is a casket required for burial?
While state law does not require a casket, most established cemeteries in Ohio require a casket and an outer burial container (vault) to prevent the ground from settling. We can help you check the specific requirements of your chosen cemetery.
What is an "Immediate Burial"?
This is a simple burial where the body is interred shortly after death without embalming, viewing, or a formal ceremony. It is often chosen by families seeking an economical and straightforward option.
Can we bury cremated remains?
Yes. Many cemeteries have designated "urn gardens" or allow cremated remains to be buried in a family plot or placed in an above-ground columbarium.

Is my pre-paid plan transferable?
Yes. If you move or choose to change providers, your pre-arranged funeral contract with Lusain Funeral Home and Crematory Ohio can typically be transferred to any funeral home in the United States.
